Terms of Service
Effective Date: 8/24/2025
These Terms of Service (“Terms”) govern your use of the website and services provided by Macklin Automotive (“we,” “our,” or “us”). By using our website, booking an appointment, approving an estimate, signing a repair order, authorizing work verbally/electronically, or purchasing services, you agree to these Terms.
1. Services Provided
We provide automotive maintenance, repair, lift kit installations, performance upgrades, diagnostics, fabrication, and related services. Details of specific work, pricing, and timelines will be provided in your estimate or invoice.
1A. Diagnostic Services
Diagnostic services may include road testing, drivability verification, calibration checks, alignment evaluation, post-repair inspection, or operation under normal driving conditions necessary to duplicate or verify customer concerns.
Diagnostic conclusions are based on symptoms and conditions present during inspection. Intermittent concerns may not duplicate during testing, and additional failures may become visible once repairs or disassembly begin.
1B. Estimates & Additional Repairs
Estimates are based on visible conditions and information available at the time of inspection and may change if additional issues, hidden damage, seized hardware, corrosion, prior repairs, or incomplete/incorrect parts are discovered during the repair process.
Any additional repairs, labor, parts, or services identified during the repair process will require customer approval prior to proceeding.
Macklin Automotive reserves the right to decline or stop work if a vehicle is deemed unsafe, improperly modified, abandoned, or otherwise unserviceable.
2. Payment Terms
We accept payments via Klarna Pay Over Time, Sunbit, Affirm, Synchrony, Stripe, Chase, cash, and major credit/debit cards.
Payment is due in full upon completion of services unless otherwise agreed in writing.
2A. Deposits & Special-Order Parts
Deposits may be required for certain custom work, diagnostic services, fabrication, performance upgrades, or special-order parts, and the amount will vary at the discretion of Macklin Automotive.
Deposits are generally nonrefundable, but may be partially refundable at our discretion depending on:
• Time and labor already invested
• Diagnostic services performed
• Restocking fees for special-order or unused parts
• Supplies or administrative costs incurred
Cancelled jobs or special-order parts are subject to a 20% restocking/cancellation fee, in addition to any supplier refund policies or restrictions.
2B. Financing & Payment Disputes
Financing agreements, payment plans, installment services, or credit arrangements through Klarna, Sunbit, Affirm, Synchrony, credit card issuers, or any third-party financing provider remain solely between the customer and the financing provider and do not alter or waive Macklin Automotive’s Terms of Service, payment policies, cancellation policies, storage policies, or warranty terms.
Customers initiating payment disputes, chargebacks, or credit card disputes for authorized services may be subject to collections activity, legal remedies, recovery of associated fees/costs, and refusal of future service at the discretion of Macklin Automotive.
3. Storage Fees
Vehicles must be picked up within 24 hours of notification of completion unless other arrangements are made and agreed upon by Macklin Automotive.
3A. Standard Storage Fees
After the initial 24-hour grace period, storage charges of $35 per day may apply.
Storage charges are subject to Indiana’s statutory maximum lien amount (currently $1,500).
Notice of storage charges will be provided to the customer and lienholder as required by Indiana law.
3B. Operational Delays & Bay Occupancy Charges
Vehicles delayed due to unpaid balances, delayed approvals, customer-supplied parts issues, incomplete kits, abandoned projects, or lack of customer communication may incur storage, bay occupancy, scheduling disruption, or administrative charges of $200 per 24-hour period, prorated for partial days.
Macklin Automotive reserves the right to stop work, remove vehicles from service bays, relocate vehicles, or tow vehicles at the customer’s expense if invoices remain unpaid, communication ceases, customer-supplied parts are incomplete/delayed, or the vehicle is otherwise abandoned or disrupting shop operations.
4. Interest on Unpaid Balances
All balances are due at the time services are completed unless otherwise agreed in writing.
Any balance not paid when due will immediately begin accruing interest at 8% per annum (simple interest), or the maximum rate permitted by law. Interest accrues until the balance is paid in full.
5. Legal & Collection Costs
Customers are responsible for all reasonable costs of collection, including but not limited to attorney’s fees, court costs, lien filing fees, certified mailing costs, towing expenses, administrative expenses, and recovery costs associated with unpaid balances or abandoned vehicles.
These costs may be added to the outstanding balance if enforcement is necessary.
6. Warranties & Disclaimers
We provide warranty coverage on qualifying repairs and parts as outlined in our warranty policy.
Warranty does not cover normal wear and tear, damage due to misuse, neglect, racing, off-road use, improper maintenance, abuse, or modifications not performed by us.
6A. Customer-Supplied Parts
We are not responsible for failure of customer-supplied parts, used, or aftermarket components not purchased through Macklin Automotive & Performance.
Customers must disclose any customer-supplied parts prior to estimate preparation and scheduling.
Estimates prepared using Macklin Automotive-sourced parts, pricing, labor structure, or kit configurations may require revision if the customer later chooses to supply their own parts.
Customer-supplied parts may require additional labor time for fitment verification, hardware identification, compatibility research, troubleshooting, missing components, incomplete kits, installation delays, or improperly supplied components. Additional labor charges may apply depending on the size and complexity of the job.
If a vehicle occupies a service bay due to customer-supplied part issues, missing components, delayed approvals, or incomplete kits, additional labor, storage, scheduling disruption, or administrative charges may apply.
Macklin Automotive does not warranty customer-supplied parts or related component failures. Labor performed remains billable regardless of part failure or fitment concerns.
Customers may not use a Macklin Automotive estimate or parts list to independently purchase parts and then expect the original labor quote, scheduling priority, warranty terms, or completion timeline to remain unchanged.
6B. Modified, Off-Road & Performance Vehicles
Modified vehicles may not retain factory ride quality, drivability, braking characteristics, steering feel, handling, tire wear patterns, emissions compliance, fuel economy, reliability, or manufacturer warranty coverage.
Lift kits, oversized tires, suspension systems, tuning, forced induction, fabrication, drivetrain upgrades, and aftermarket modifications place additional stress on vehicle components and may increase the likelihood of wear or failure.
Off-road and performance vehicles may experience vibrations, driveline noise, bump steer, wandering, accelerated tire wear, harsh ride quality, or other characteristics considered normal for modified vehicles.
Midwest corrosion, seized hardware, prior modifications, hidden damage, or improperly installed aftermarket parts may require additional labor, replacement hardware, fabrication, or repairs during service.
6C. Road Test Authorization & Hold Harmless
Customer authorizes Macklin Automotive to operate and road test the vehicle as necessary for diagnostics, calibration verification, drivability concerns, alignment evaluation, quality control, and post-repair inspection. Customer acknowledges that reasonable mileage may be added during the diagnostic and repair process.
Customer agrees to hold harmless and release Macklin Automotive, its owners, employees, and affiliates from liability related to pre-existing vehicle conditions, mechanical failures, aftermarket modifications, unsafe conditions, or component failures that may occur during normal diagnostic or repair-related operation of the vehicle.
6D. Marketing & Media Authorization
Customer authorizes Macklin Automotive to photograph, video record, and use images or video of the vehicle, installed components, fabrication work, diagnostic processes, and related shop activity for marketing, advertising, social media, website, promotional, or educational purposes unless the customer explicitly requests otherwise in writing prior to services being performed.
No personal customer information will be intentionally disclosed without consent.
7. Limitation of Liability
To the fullest extent permitted by law, our liability for any claim related to services provided is limited to the amount paid for those services.
We are not liable for indirect, incidental, consequential, punitive, or special damages including towing, rental expenses, downtime, lost wages, lost profits, or loss of vehicle use.
Macklin Automotive is not responsible for loss or damage caused by pre-existing conditions, prior repairs, aftermarket modifications, hidden damage, seized components, rust/corrosion, manufacturer defects, customer-supplied parts, or failures unrelated to services performed.
8. Customer Responsibilities
Provide accurate and complete information regarding your vehicle and contact details.
Approve all work before it begins; changes to approved work may result in additional charges.
Comply with pickup requirements outlined in Section 3 regarding completed vehicles and storage fees.
8A. Follow-Up Maintenance & Inspections
Customer is responsible for following any recommended break-in procedures, retorque inspections, alignment checks, fluid changes, maintenance schedules, or follow-up inspections associated with repairs, lift kits, performance upgrades, driveline components, or modified vehicle installations.
9. Appointment & Cancellation Policy
Please provide at least 24 hours’ notice to cancel or reschedule an appointment.
Missed appointments without notice may result in a cancellation fee.
Refunds or cancellations involving deposits will be handled according to our Payment Terms (Section 2).
10. Discounts & Promotions
All discounts, coupons, promotions, or special offers are subject to final approval by the owners of Macklin Automotive & Performance.
Discounts cannot be combined unless explicitly stated in writing.
We reserve the right to modify or revoke any discount or promotion at our discretion.
11. Mechanic’s Lien Rights
11A. Mechanic’s Lien
We retain a mechanic’s lien on any vehicle left for repair or service until all charges (repairs, storage, interest, diagnostics, administrative costs, towing expenses, collection costs, and enforceable fees) are paid in full.
We reserve the right to enforce this lien under Indiana Code 32-33-10, including sale of the vehicle at public auction if payment is not received.
11B. Collections & Vehicle Recovery
We reserve the right to contact lienholders of record for collection purposes if balances remain unpaid.
We may, at our discretion, have a vehicle towed or relocated at the customer’s expense if it is abandoned or not picked up after reasonable notice.
Customer agrees that storage charges, towing expenses, administrative costs, diagnostics, authorized repairs, special-order parts, collection expenses, and applicable legal fees may be included in enforceable lien balances as permitted under Indiana law.
12. Intellectual Property
All content on our website, including logos, images, and text, is the property of Macklin Automotive & Performance and may not be used without our written consent.
13. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.
14. Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with a new effective date.
Your continued use of our website or services constitutes acceptance of the updated Terms.
